VACUUM: THE GLOBAL COMPETITION
TERMS AND CONDITIONS
(As of April 1, 2010)
1. DESCRIPTION OF THE CONTEST
"The Global Competition" (the “Contest”) is a product promotion and Game of Skill (as defined below) in which licensed users of Vacuum, "The Application", (as defined below) are eligible to participate in the Contest for the grant of the Prize specified in these Terms and Conditions.
2. SPONSOR
The Contest is sponsored by Door-6 Inc. ("Door-6"), a Wisconsin corporation with principal place of business at 520 University Ave Suite 235 Madison, WI 53703. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Door-6 reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Door-6 may change the Terms and Conditions from time to time and at any time without notice, by posting such changes on this Website and indicating the date of the most recent revision.
3. END-USER AGREEMENT
In order to enter the Contest, you must agree to these Terms and Conditions. Therefore, please read these Terms and Conditions prior to entry to ensure you understand and agree. After reading the Terms and Conditions and in order to participate, each Participant must enter their email address within the "Player Profile Dialog" within the Application signifying acceptance of these Terms and Conditions. Users are not eligible to receive the Prizes described in these Terms and Conditions unless they agree to these Terms and Conditions.
4. DEFINITION OF THE APPLICATION
"Vacuum" is a graphically animated game. The "Player Profile Dialog" is an element of the Application, accessible from the Options menu of the Application, allowing the user to enter a "Nickname" to represent themselves on the "High Scores Board", and an email address signifying that the Participant agrees to these terms and conditions.
The Application is commercially available for purchase, by way of digital download, from online stores owned and/or operated by Google Inc., and other yet to be selected stores, in select jurisdictions (the “Stores”), subject to availability and observance of the terms and conditions applicable to transactions with, or of, each Store.
THE CONTEST IS NOT OPEN IN ALL OF THE COUNTRIES, JURISDICTIONS, STATES OR PROVINCES IN WHICH THE APPLICATION IS AVAILABLE FOR SALE; PLEASE REFER TO SECTION 6 (ELIGIBILITY).
5. GAME OF SKILL, NO GAMBLING
There is no gambling or betting or wagering involved in the Contest or the Application. Playing the Application is no different from carnival games, golf tournaments or other skill-based games that are played for cash or prizes in the real world.
6. ELIGIBILITY
The Contest is open to individuals, referred to as a "Participant" (eligible users) in these Terms and Conditions, worldwide, except as set forth below, who have agreed to these Terms and Conditions (as described in Section 3) and meet any applicable U.S., national, state, local, or provincial legal requirements for participation. Door-6 makes no representations or warranties, implicit or explicit, as to your legal right to participate in The Contest. You are subject to all laws of the state, province and/or country in which you reside and from which you submit Scores and are solely responsible for obeying those laws. You agree that Door-6 cannot be held liable, if laws applicable to you restrict or prohibit your participation. As a guideline, in the U.S., rules governing Tournaments with prizes are set up by each individual state, not by the federal government. Void where prohibited. Employees of (i) Door-6, (ii) members of their immediate families (defined as parents, children, siblings and spouse, regardless of where they reside and/or those living in the same household of each) are not eligible to participate in the Contest. Door-6 reserves the right to verify eligibility and to adjudicate on any dispute at any time.
To be eligible to receive a prize, a Participant must have entered their email address within the Application in the "Player Profile Dialog". At the end of the Contest (Section 10) the winning Participants will be contacted via email to provide their personal information (Full Name, Age, Residence, and Email Address associated with the purchase of the application) in order to confirm eligibility. If a Participant does not provide this necessary information, they will forfeit their eligibility to receive a Prize.
7. SUBMISSION OF SCORES
To qualify for a Prize, a Submission to the Contest consists of a Score (defined below), "Nickname" (described in Section 4), and email address. All users of the Application, regardless of eligibility to compete in the Contest, may submit Scores and appear on the "High Scores Board".
8. DEFINITION OF THE SCORE
The application, presents the user with a Score that represents how well they did in the Application. Score is calculated in the following way:
Each new session of the Application begins with a Timer (displayed in the top right corner of the screen). The Timer has 30 seconds on it, and counts down as the user progresses through the game. The user interacts with the Application by tilting their device and using on screen controls. When the user passes through a "Green Orb" in the game, 5 seconds are added to the Timer. When the user passes through a "Blue Ring" the amount of time on the timer is added to the Points total (displayed in the top left corner of the screen). Nothing different occurs when the timer reaches zero. When the user runs into the wall of the virtual tunnel or into a virtual asteroid, the session ends. At this point, the user's score is submitted (defined in Section 7).
9. PRIZES
The three (3) Participants, after confirmed to be eligible, with the highest submitted Scores are the recipients of Prizes when the Contest ends (defined in Section 10). A Participant is only eligible to receive one (1) Prize.
The Participant responsible for the highest submitted Score ("Winner One") will receive a prize of $500 USD (Five hundred United States Dollars). The Participant responsible for the second highest submitted Score ("Winner Two"), ignoring any higher scores by Winner One, will receive a prize of $250 USD (Two hundred and fifty United States Dollars). The Participant responsible for the third highest submitted Score ("Winner Three"), ignoring any higher scores by Winner One or Winner Two, will receive a prize of $100 USD (One hundred United States Dollars).
In the event of an exact tie (two or more Participants with identical submitted Scores) the Prizes will be awarded based on the order of the tied Participants next best score.
[For example, if A B and C all submit a Score of 1000, A submits a next-best score of 900, B submits a next-best score of 800, and C submits a next-best score of 700. A will receive $500, B will receive $250, and C will receive $100.]
10. CONTEST TIMELINE
All Scores must be submitted within the Submission Period.
The Submission Period begins 11:59:59 P.M. Central Time (CDT) Zone in the United States on March 31, 2010.
The Submission Period ends at 11:59:59 P.M. CST on May 31, 2010.; however, Door-6 reserves the right, in its sole discretion, to terminate the Submission Period prior to 11:59:59 P.M. CDT on May 31, 2010.
When the Submission Period begins, the "High Scores Board" will reset, so that no Scores submitted previous to 11:59:59 P.M. CDT on March 31, 2010 are visible or eligible for a Prize.
Winners will be notified on or before July 15, 2010.
PARTICIPANTS ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE IN THEIR RESPECTIVE JURISDICTIONS.
11. TAXES
ALL TAXES IMPOSED ON THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE PRIZE RECIPIENT.
12. PRIVACY POLICY
Door-6 will not intentionally disclose any personally identifying information about you (including information submitted through the Application, your e-mail and information regarding your IP address) to third parties without your consent, except where Door-6, in good faith, believes such disclosure is necessary to comply with the law or to enforce these Terms and Conditions. Your acceptance of any prize from Door-6 constitutes consent for the disclosure of personal information as described above. We monitor player traffic patterns and Application usage to help us develop and enhance the Application and Contest.
